Immigration Habeas Corpus Petitions in Federal Court

Challenging unlawful immigration detention

Detention location comes first

We handle immigration habeas corpus matters only in specific jurisdictions and certain United States District Courts. Before accepting a case, we evaluate where the person is detained, the procedural history, and whether our firm can pursue relief in the appropriate court.

No outcome or timeline can be guaranteed. A habeas petition is not an immigration court filing and does not automatically stop removal or resolve the underlying immigration case.

When a loved one is detained by Immigration and Customs Enforcement (ICE), every day in custody can be difficult for the detainee and their family. In some cases, the immigration court system may not provide an adequate or timely remedy for a person who is being held in immigration custody. When detention becomes unlawful, prolonged, or constitutionally questionable, a petition for a writ of habeas corpus in federal court may provide an important avenue for relief.

At Ahmad & Associates, we represent immigrants in complex immigration and federal litigation matters. We evaluate immigration detention cases and, where appropriate, pursue habeas corpus relief in certain United States District Courts.

We handle immigration habeas corpus matters in specific jurisdictions. If you or someone you love is being held by ICE and you believe the detention is unlawful or has continued without a meaningful opportunity for release, contact our office to discuss the available legal options and whether our office can file a habeas corpus petition for your family member.

What Is a Habeas Corpus Petition?

A writ of habeas corpus is one of the oldest and most important protections of individual liberty in American law. The phrase habeas corpus is commonly understood as a legal mechanism through which a person in government custody can ask a federal court to examine whether that custody is lawful.

In immigration cases, a habeas corpus petition may be filed in federal district court to challenge certain forms of immigration detention. Unlike proceedings before an Immigration Judge or the Board of Immigration Appeals, a habeas case brings the legality of a person's detention before a federal judge.

A successful habeas petition may, depending upon the facts and applicable law, result in relief such as:

  • Release from immigration detention;
  • A new or constitutionally adequate bond hearing;
  • Review of whether ICE has legal authority to continue detention;
  • Other appropriate relief concerning unlawful custody.

Every case is different, and the availability of habeas relief depends on the particular facts, procedural history, location of detention, and current state of the law.

When Might an Immigration Habeas Corpus Petition Be Appropriate?

Federal habeas corpus litigation may be appropriate in a variety of immigration detention situations. Our attorneys carefully review the circumstances of each case to determine whether a federal court challenge may be available.

Examples of situations that may warrant a habeas corpus evaluation include:

Prolonged Immigration Detention

Immigration detention is civil rather than criminal. Nevertheless, some immigrants remain in custody for extended periods while their removal proceedings, appeals, or travel arrangements remain unresolved. Prolonged detention may raise important statutory and constitutional questions, particularly where there has been no meaningful opportunity to seek release.

Detention Without a Meaningful Bond Hearing

Some immigrants are told that they are not eligible for a bond hearing or are denied an opportunity to have a neutral decision-maker consider whether continued detention is justified. Depending on the circumstances, a federal court may be asked to review whether the procedures surrounding detention satisfy applicable legal and constitutional requirements.

Continued Detention After a Final Order of Removal

In certain circumstances, an immigrant may remain in ICE custody long after receiving a final order of removal. When removal is not reasonably foreseeable or detention continues beyond the period permitted by law, a habeas corpus petition may provide a means of challenging continued custody.

Detention Based on an Incorrect Legal Classification

Immigration detention laws are complex. Whether a person is subject to mandatory detention, discretionary detention, or post-removal-order detention can depend upon the person's immigration history, criminal record, procedural posture, and other factors. When the government applies the wrong legal standard or misclassifies an individual's detention authority, federal court review may be appropriate.

Constitutional or Due Process Concerns

The federal courts may also consider certain constitutional challenges relating to immigration detention, including whether a detainee has received the procedural protections required by law. These cases are highly fact-specific and require careful analysis of the immigration record and the applicable federal law.

Federal Court Litigation Requires a Different Approach

A habeas corpus petition is not simply another immigration court filing. It is a form of federal litigation that requires a careful understanding of immigration law, constitutional principles, federal procedure, and litigation strategy.

A successful federal habeas case often requires counsel to review and analyze a substantial record, which may include:

  • ICE detention records;
  • Notices and charging documents;
  • Immigration court decisions;
  • Bond hearing records;
  • Board of Immigration Appeals decisions;
  • Criminal and conviction records, where applicable;
  • Prior petitions and appeals;
  • The history and length of detention.

The petition must clearly explain why the detention is unlawful and identify the legal basis for the federal court to grant relief. In appropriate cases, additional motions for expedited or emergency relief may also be necessary.

At Ahmad & Associates, we bring together experience in immigration law, federal litigation, and appellate practice to analyze these complex cases and advocate for our clients.

Because immigration habeas corpus cases generally involve important questions about where a petition must be filed and which federal court has jurisdiction over the detention, determining the correct court is an essential part of evaluating a case. We carefully review where the individual is detained and the procedural circumstances of the case before determining the appropriate legal strategy.

Our Approach to Immigration Detention Cases

When a family contacts us about a loved one in ICE custody, we understand that the situation can be urgent. Our first step is to carefully evaluate the individual's circumstances and determine what legal remedies may be available.

Our approach may include:

1. Reviewing the Detention and Immigration History

We examine why the person is detained, how long they have been in custody, and what has occurred in the immigration proceedings.

2. Identifying Available Remedies

A habeas corpus petition is not appropriate in every detention case. In some situations, a bond hearing, appeal, motion before the immigration court, or another immigration remedy may be the better first step. We evaluate the available options and explain the potential strategies.

3. Developing a Federal Litigation Strategy

When federal habeas relief is appropriate, we prepare the case with the level of analysis and attention required for litigation in federal court. This includes identifying the relevant statutory, constitutional, and procedural issues.

4. Advocating for Meaningful Relief

Depending upon the circumstances, the objective may be release from custody, a new bond hearing, or another form of relief that addresses the unlawful detention. We advocate vigorously for our clients while providing honest advice about the strengths and challenges of each case.
